Terms of Service

1. Acceptance of Terms

By accessing or using the SecureScope platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Service Description

SecureScope is a multi-tenant security analysis platform providing static application security testing (SAST), software composition analysis (SCA), compliance framework mapping, and related vulnerability management services. The Service is provided as software-as-a-service (SaaS) and, for Enterprise customers, as an on-premise deployment.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must:

• Provide accurate and complete registration information
• Promptly notify us of any unauthorised use of your account
• Not share credentials or allow multiple users to use a single account
• Comply with all applicable laws when using the Service

4. Billing and Payment

Subscription fees are charged in advance on a monthly or annual basis. Per-developer pricing is calculated based on active developers in scanned repositories during the billing period.

Payments are processed through Flutterwave (for African markets) or supported card payment processors. All prices are in USD unless otherwise stated. Taxes may apply based on your jurisdiction.

5. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We process your data to provide the Service, maintain security, and comply with legal obligations. Source code submitted for scanning is processed solely for the purpose of identifying security vulnerabilities and is not used for any other purpose.

6. Acceptable Use

You must not use the Service to:

• Scan code or systems for which you do not have authorisation
• Circumvent or attempt to circumvent tenant isolation controls
• Reverse engineer or extract the underlying scanning engine
• Use the Service in violation of any applicable law

7. Intellectual Property

The Service, including all software, algorithms, and documentation, is the intellectual property of SecureScope. You retain all rights to your source code and scan results. We do not claim ownership of any customer data submitted to the Service.

8. Termination

Either party may terminate these Terms at any time. Upon termination, your access to the Service will cease. We will provide a data export for 30 days following termination. After that period, your data will be deleted in accordance with our data retention policy.

9. Limitation of Liability

To the extent permitted by law, SecureScope's liability is limited to the fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages arising from your use of the Service.

10. Governing Law

These Terms are governed by the laws of Kenya. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notification. Continued use of the Service after the effective date of any change constitutes acceptance of the updated Terms.
